Jim,
Could you clarify, or at least try to explain in lay terms, the definition of 'commercial'? Specifically, how might it apply to the development of an application that could be used by either a commercial or non-commercial (educational, governmental) entity, but not specifically developed with intent of making a profit? For example, is using VWNC analogous to, say, using Eclipse + open-source Java libraries? What about profit from services related to the application (deployment, maintenance, etc)? I am assuming those would fall under the 'must have a contract' portion but I'd like to know for sure.
